PreConstruction Canada (“we”, “us”) helps buyers, investors and realtors find pre-construction homes in Canada. Real estate services are provided through Best Sellers Realty Inc. Brokerage. This policy explains what personal information we collect through preconstructioncanada.com, how we use it, and the choices you have. We follow Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL).

1. Information we collect

Information you give us. When you fill out a form, request floor plans or pricing, submit a worksheet, join our mailing list or contact us, we may collect:

  • your name, email address and phone number
  • the projects, unit types and areas you’re interested in
  • details you choose to share about your budget, timeline, financing, or whether you work with a realtor
  • anything you write in a message to us

If you are a realtor or builder, we may also collect your company name and role.

Information collected automatically. When you visit the site, we and our service providers may collect technical information such as your IP address, browser and device type, the pages you view, how you arrived at the site (for example, from a search engine or an ad), and the date and time of your visit. This is collected using cookies and similar technologies (see section 6).

2. How we use your information

We use your information to:

  • respond to your questions and requests
  • send you the project information, floor plans and pricing you ask for
  • register your interest with builders, or submit a worksheet on your behalf, when you ask us to
  • arrange consultations and follow up about properties that match what you’re looking for
  • send you newsletters and updates about new projects and incentives, if you’ve agreed to receive them
  • understand how people use our site so we can improve it
  • meet our legal and regulatory obligations, including real estate rules and federal anti-money-laundering requirements, which require us to verify the identity of clients in some transactions

We only collect what we need for these purposes.

3. Your consent

By submitting a form on this site, you consent to us using your information as described in this policy. You can withdraw your consent at any time by contacting us (see section 10), subject to legal or contractual limits. If you withdraw consent, we may not be able to provide some services, such as registering you for a project.

4. When we share information

We do not sell your personal information. We share it only:

  • with builders, developers and their sales teams, when you ask us to register you for a project or submit a worksheet
  • with Best Sellers Realty Inc. Brokerage and its registered salespeople, who provide the real estate services
  • with service providers that help us run our business, such as our customer relationship management and email platform (HubSpot) and our website host, who may only use your information to provide services to us
  • when required or permitted by law, for example to comply with a court order or a regulator

5. Where your information is stored

Some of our service providers store or process information outside Canada, including in the European Union and the United States. While your information is outside Canada, it may be accessible to the courts, law enforcement and national security authorities of those countries.

6. Cookies and analytics

Our site uses cookies and similar technologies, including tools provided by HubSpot, to understand how visitors use the site, remember your preferences, and connect your form submissions with the pages you viewed so we can send you relevant information. You can block or delete cookies in your browser settings. The site will still work, but some features may not.

7. Emails

We only send you marketing emails if you’ve agreed to receive them or as otherwise permitted by CASL. Every marketing email includes an unsubscribe link, and you can ask us to stop at any time. We may still contact you about a request or transaction you are involved in.

8. How long we keep information

We keep personal information only as long as we need it for the purposes above, or as long as required by law (for example, records relating to real estate transactions). After that, we delete it or make it anonymous.

9. How we protect information

We use reasonable physical, organizational and technical safeguards, such as access controls and password-protected systems, to protect your information. No website or email transmission is completely secure, so please don’t send sensitive information such as banking details through our website forms.

10. Your rights and how to contact us

You can ask to see the personal information we hold about you, ask us to correct it, or withdraw your consent. To do so, or if you have a question or concern about privacy, contact our Privacy Officer at preconstruction@ayatrealty.com. We will respond within 30 days.

If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada.

We may update this policy from time to time. The “Last updated” date at the top shows when it was last changed.
